Please read these Terms of Service ("Terms") carefully before using the TinyGamer AI mobile application (the "App") operated by TinyGamer AI ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms.

1 Eligibility

TinyGamer AI is designed to be enjoyed by users of all ages. No account creation or login is required. However, certain conditions apply depending on age:

• Children under 13: May use the App only under the direct supervision of a parent or legal guardian. The parent or guardian is responsible for all activity and purchases made on the child's behalf. Since the App does not collect any personal information, no parental consent form is required to use the App itself; however, any in-app purchases must be made by the parent or guardian.
• Users aged 13–17: May use the App freely. Any in-app purchases must be authorized by a parent or legal guardian.
• Users 18 and over: May use all features of the App independently.

2 Account & Authentication

No registration or login is required to use TinyGamer AI. When you first open the App, a unique anonymous identifier is automatically generated for your device. This identifier is used solely to associate your games and credit balance with your session — we do not collect your name, email address, or any other personal information as part of this process.

Because your session is device-based and fully anonymous:

• Your data is tied to the device you are using. If you uninstall the App or switch to a new device, your game history and remaining credits may not be recoverable unless you have made in-app purchases (see Section 3.4).
• You are responsible for any activity that occurs under your device's anonymous session.
• If you suspect your account has been tampered with or misused, contact us at support@tinygamerai.com.

We reserve the right to suspend or terminate sessions that violate these Terms.

3 Credits & Purchases

3.1 What are Credits?

Credits are the in-app currency used to generate games. They are a consumption unit, not a game count. The number of credits deducted per game generation depends on the length and complexity of your prompt:

• 1–100 characters: 1 Credit
• 101–300 characters: 3 Credits
• 301+ characters: 7 Credits

3.2 Purchasing Credits

Credits are purchased through the Apple App Store using in-app purchase packages. All transactions are processed by Apple and are subject to Apple's payment terms. We do not collect or store your payment information directly.

If you reinstall the App or switch devices, you can restore previously purchased credits using the "Restore Purchases" feature in the App. Purchases are linked to your Apple App Store account and can be recovered on any device using the same Apple ID used at the time of purchase.

4 AI-Generated Content

By using the game generation feature, you acknowledge that:

• Generated games are created automatically and have not been reviewed or approved by a human editor.
• Game output quality can vary significantly depending on the length and clarity of your prompt.
• We are not responsible for any errors, bugs, or unintended content in AI-generated games.
• Failed generations (where the AI cannot produce a playable result) may result in credits not being charged, or a refund being applied automatically.

5 Intellectual Property & Ownership

5.1 Your Prompts

You retain ownership of the text prompts you write. By submitting a prompt, you grant TinyGamer AI a worldwide, royalty-free, non-exclusive license to use, store, and process that prompt solely for the purpose of generating your game and improving our service.

5.2 Your Generated Games

The games generated by the AI based on your prompts are stored privately in your personal library within the App and are for your own use only. The App does not currently include any feature to publicly share or publish user-generated games to other users.

5.3 Explore Section

The Explore section of the App displays a curated set of sample games created and maintained by TinyGamer AI. These are not games created by other users — they are platform-provided examples intended to demonstrate the App's capabilities and inspire new ideas. All content in the Explore section is the property of TinyGamer AI.

5.4 Our Platform

All other aspects of the App — including its design, branding, trademarks, logos, underlying infrastructure, and all non-user-generated content — are the exclusive property of TinyGamer AI and are protected by applicable intellectual property laws.

6 Acceptable Use

You agree not to use the App to:

• Generate content that is illegal, harmful, hateful, sexually explicit, or promotes violence.
• Attempt to reverse-engineer, exploit, or misuse the AI generation system.
• Use automated bots, scripts, or tools to generate games in bulk or abuse the credit system.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Upload or transmit viruses or any other malicious code.
• Circumvent, disable, or otherwise interfere with security-related features of the App.

We reserve the right to remove any generated content and block access from any device session that violates these guidelines without prior notice.

7 Third-Party Services

The App integrates the following third-party services, each governed by their own terms and privacy policies:

• Apple: Payment processing via the App Store. TinyGamer AI does not use Apple for user authentication — all users are anonymous.
• RevenueCat: In-app purchase management and subscription tracking.
• Google AI / Anthropic Claude / OpenAI: Large language model APIs used to generate game code from your prompts. Your prompts are sent to these APIs; no personal identifiers are included.

We are not responsible for the practices or policies of these third-party providers.

8 Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, TINYGAMER AI DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• The continuous, uninterrupted, or error-free operation of the App.
• The accuracy, reliability, or completeness of any AI-generated output.
• That the App will meet your specific requirements or expectations.

9 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TINYGAMER AI AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall our total liability to you for all claims exceed the amount you paid to us in the twelve (12) months preceding the claim.

10 Termination

You may stop using the App at any time. You may also delete your session data through the "Delete Account" option in the App's settings. Upon deletion:

• Your anonymous device identifier and all associated game data stored on our servers will be permanently removed.
• Any remaining unused credits will be forfeited and are non-refundable.

Since TinyGamer AI does not collect any personal information, there is no personal profile to delete beyond your anonymous session and its associated content.

We reserve the right to block access from any device session at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to the service or other users.

11 Changes to These Terms

We may revise these Terms at any time. If we make material changes, we will update the "Last Updated" date at the top of this page. Continued use of the App after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
